This privacy policy for Organizations (“Privacy Policy”) is to describe how MentorTech Collective Foundation, (“Mentortech Collective”, “us”, “we” or “our” or “MCF”) deals with the Information (as defined hereinafter) about the Organizations on its Portal as well as how the Organizations (collectively referred as “You”) provide Organization Content on the Portal. All capitalised terms used in this Privacy Policy but not defined herein shall have the same meaning as ascribed to them in the Terms of Use available at https://mentortogo.org/terms-of-use/

We recognize the importance of Your privacy and are committed to ensuring that You are aware of how Your Information is being used.

The use of the Portal by the Organization will be governed by this Privacy Policy together with all policies, notices, guidelines, disclaimers that are published and shared with the Organizations from time to time which are incorporated herein by way of reference including but not limited to terms and conditions and such other terms as may be applicable to the User and the Organization in its capacity as a user of the Portal. All capitalized terms used in this Privacy Policy but not defined herein shall have the same meaning as ascribed to them in the Organization Terms of Use available at https://mentortogo.org/terms-of-use/.

This Privacy Policy in the electronic form, shall be enforceable against the Organization in the same manner as any other written agreement. Please read this Privacy Policy carefully.

Please use and access the Portal only if You agree with our policies and practices encapsulated in this Privacy Policy and the Terms of Use. APPLICABILITY OF THE POLICY

This Privacy Policy shall apply to all Information MCF collects about the Organizations. The Privacy Policy does not apply to, nor does MCF take any responsibility for, any information that is collected by any third party using the Portal.

PURPOSE

The purpose of this Policy is to ensure that the information provided by the Organization is used, processed, disclosed, and stored in accordance with applicable law. The information stored in such manner shall be protected by MCF in accordance with the terms and conditions set out in this Privacy Policy. MCF’s Privacy Policy explains:

  1. What information is collected and why such information is collected;
    1. How such information is used; and
    1. How such information can be accessed and updated.

NATURE OF INFORMATION COLLECTED AND MANNER OF COLLECTION

As You navigate through the Portal, MCF may collect different types of information, collectively hereinafter referred to as “Information”. This Information could be of the following types:

  • “Sensitive Personal Information”: information such as Your financial data, password and such other information collected from time to time;   
  • “Personally Identifiable Information”: information that could be used to identify You such as Your organization name, email address, location/address, sphere of work, Representative’s details and other similar information including any User Information; 
  • “Non-Personal Information” – information that cannot be used to identify You including but not limited to cookies; 
  • “Device Information”- information which is automatically collected about the operating system or version of the system from which the Portal is used.

MCF may also collect information about the searches that You have carried out on the Portal or third-party links that You have visited, any emails, messages, audio or video conversations, or other correspondence You may have sent or exchanged with Users, other Organizations or their Representatives on the Portal or with MCF. 

MCF may also aggregate such data available on the Portal, including but not limited to information, documents, resumes, biodata, web-crawling, content and Feedback provided by the Organization/s to create a repository, master file or any other aggregated data set of skills, trends, domain knowledge or Organization preferences for use of the same by MCF for any lawful purpose whatsoever including to create and/or customize the content to suit various requirements of the Organizations.

If You have been granted access to the Portal through a third party that may have a data sharing arrangement with MCF and You have granted the third – party consent to collect Your data, MCF may share Your data pursuant to Your consent, in accordance with the terms of the data sharing arrangement.

You are responsible for ensuring the accuracy of any Information You submit to MCF. Inaccurate Information may affect Your ability to use the Portal, the Information You receive when using the Portal, and our ability to contact You. 

You understand that the Information collected by MCF, may be collected directly or through automatic tracking of Your usage of the Portal through the use of cookies or other tracking technologies. The data automatically collected may include usage information such as details of Your computing and/or communication device, location, connections, or any information that MCF may collect through the use of cookies and other tracking technologies. You may decline these cookies by changing Your browser settings, if permitted. However, do note that this may impact certain features of the Portal or Your experience in using the Portal.

You also may provide Information to be published or displayed or posted on the Portal or transmitted to other Users or other Organizations of the Portal or third parties. Any such Information that is posted or transmitted to other parties will be at Your own risk and will not be monitored by MCF for its content or compliance. Please be aware that MCF cannot control the actions of other Users and Organizations of the Portal with whom You may choose to share Information. 

USE OF YOUR INFORMATION

The Information that we collect on the Portal will be used for the following purposes:

  • Correspondence/communication with You pursuant to Your identity as an Organization/Representative or Your usage of the Portal;
  • Verification of Your Organization account, if applicable;
  • Ensuring that the content from the Portal is presented in the most effective manner for You and for Your device;
  • To provide You with newsletters, information, products or Services that You request from us which we feel may interest You, where You have consented to be contacted for such purposes;
  • To notify You about changes to the Portal, this Privacy Policy or the Terms of Use;
  • For the purpose of studying usage patterns;
  • For analytical purposes, including but not limited to assessing usage data, usage patterns, estimate audience sizes and other similar activities;
  • To provide technical support, or to investigate and identify problems with the system;
  • To improve the system or the experience of system users;
  • To process, aggregate, analyze, benchmark, share, transfer or use the data including the content provided by the Organizations or Feedback provided by the Organizations in such manner as it deems fit;
  • In any other manner as we may describe when You provide the Information.

Except as otherwise provided herein, no Sensitive Personal Information or Personally Identifiable Information will be published, disclosed or shared with any third party without Your express consent. 

Please do not include or submit any Sensitive Personal Information or Personally Identifiable Information unless specifically requested by MCF as part of registering an Organization account or pursuant to other applicable processes. If MCF determines that any Information You have provided or uploaded violates the terms of this Privacy Policy, MCF has the right, in its absolute discretion, to delete or destroy such Information without incurring any liability to You.  

Please note that by using the Portal You acknowledge and agree to the use of Google Analytics Advertising Features on the Portal by MCF and consequently You acknowledge and agree to the collection and processing of certain Information, provided by You, by Google. However, the inclusion of a link does not imply any endorsement by MCF of the third-party website, the website’s provider, or the information on the third-party website. If the User and the Organization follow a link to any of these websites, please note that these websites may be governed by their own privacy policies and We disclaim all responsibility or liability with respect to these policies or the websites. Please check these policies and the terms of the websites before the Organization submit any information to these websites.

ANTI-SPAM

Where applicable, we will seek your express consent to contact you, including by way of commercial electronic messages. This consent is sought by MCF and you can contact us at info@mentortechcollective.org. You can unsubscribe at any time from receiving commercial electronic messages by following the instructions in the message.

Even if you have opted out of receiving marketing communications from us, please be aware that we may still contact you for other purposes. For example, we may contact you to provide communications you have consented to receive, regarding the services we provide to you, or if you contact us with an inquiry.

DISCLOSURE OF YOUR INFORMATION

We consider the confidentiality and security of Your Information to be of the utmost importance. We will use industry standard physical, technical and administrative security measures to keep Your Information including the Sensitive Personal Information and the Personally Identifiable Information (if applicable), confidential and secure and will not share it with third parties, except as otherwise provided in this Privacy Policy, or unless we have a good faith belief that such disclosure is necessary in special cases, such as in compliance with legal/ regulatory requests, to address fraud, security or technical issues or a physical threat to You or other Users or Organizations. By providing any Information on the Portal, You consent to MCF providing such Information to any governmental, law enforcement or regulatory authorities who exercise jurisdiction over MCF and the Portal, upon receiving an order to do so under applicable law. 

Despite our best efforts, MCF cannot guarantee the security of such Information because the Internet is not a 100% secure environment and there is some risk that an unauthorized third party may find a way to circumvent our security systems or that transmission of Your Information over the Internet will be intercepted. 

We may disclose Your Information to our agents, employees, advisors and affiliates who require the Information for the purposes of operating and maintaining the Portal and for facilitating Your use of the Services offered on the Portal. Whenever we hire other organizations to provide support services, they will be required to conform to our privacy standards. These third parties shall use the Information only for purposes related to the supply of services to us and they will also respect strict contractual conditions that oblige them to maintain the confidentiality of all Information.

MCF may be involved in the transaction of a merger, acquisition, sale of assets, business re-organization, bankruptcy, transfer of business or operation etc. During such a process, it may sell, transfer or otherwise share some or all of its assets which may include the information of the Organization. However, in such an event of sale or transfer, MCF shall reasonably ensure that the Organization’s information collected and stored by MCF is stored and used by the transferee in a manner that is consistent with this Privacy Policy. Any such third party to whom We transfer or sell shall have the right to continue to use the information that the Organization provide to Us or collected by Us immediately prior to such transfer or sale. On completion of the sale or transfer, the Privacy Policy of the third party shall apply with respect to the information of the Organization. To stay updated about such business transactions, please read this Policy from time to time.

We assume no liability for any disclosure of information due to errors in transmission, unauthorised third-party access or other acts of third parties, or acts or omissions beyond Our reasonable control and the Organization. The Organization will not hold Us responsible for any breach of security unless such breach has been caused as a direct result of Our gross negligence.

DATA RETENTION

MCF may retain Information, for such length of time as may be required in order for MCF to provide the concerned User or the Organization with Services or to fulfil the purpose for which such Information was collected, comply with legal obligations, resolve any disputes that may arise, enforce its rights arising out of agreements with Users or the Organizations, and/or for such period as may be required by legislations/orders of regulatory authorities to which MCF is subject. Representatives shall be entitled to remove User Information that has been collected by Representatives’ respective Organizations from the Portal, pursuant to a request to that effect made by the User, or upon the Information fulfilling the purpose for which it was collected by the Organization from the User.

PRIVACY RIGHTS

You acknowledge that the Portal is operated and managed on servers that may be located and operated in or outside the territory or country wherein You reside or operate. By using and accessing the Portal, You consent to the transfer to and processing of Your Information including the Sensitive Personal Information and the Personally Identifiable Information, on servers that may be located in or outside the jurisdiction wherein You reside, in accordance with applicable laws. Data may be transmitted to countries outside the country wherein You reside or operate for the purpose of technical support and analysis as per this Privacy Policy and shall not be stored permanently in this regard. As a result, the applicable country’s courts, governments or law enforcement agencies could obtain disclosure of Your Information in accordance with that country’s laws. If You chose to avail the Services or use of the Portal anywhere, You shall choose to do so at Your own risk and You acknowledge that You shall be solely responsible for any compliance with applicable laws in the jurisdiction from which You use the Services or the Portal.

DATA SECURITY

The Information that You provide, subject to disclosure in accordance with this Privacy Policy and Terms of Use, shall be maintained in a safe and secure manner and shall be encrypted at rest and in transit. MCF’s databases and Information are stored on secure servers with appropriate firewalls owned by MCF or by third parties.

You have the responsibility to ensure data security including that of Your Organization Information and User Information, .i.e., You may be provided certain User Information in the course of providing mentoring programs to the Users, therefore You are solely responsible for all the acts done by using such User Information. You should use the Portal in a responsible manner, and You will not take any action that will cause a breach of the use of the Portal. You are solely responsible for all acts done using User Information that has been provided to You in the course of the Services.

Given the nature of internet transactions, MCF does not take any responsibility for the transmission of Information including the User Information or Organization Content that You provide to the Portal. Any transmission of Your Information on the internet is done at Your risk. MCF does not take any responsibility for You or any third party circumventing the privacy settings or security measures contained on the Portal.

While MCF will use all reasonable efforts to ensure that Your Information is safe and secure, it offers no representation, warranties or other assurances that the security measures are adequate, safe, fool proof or impenetrable. 

FORCE MAJEURE

Notwithstanding anything contained in this Privacy Policy or elsewhere, MCF shall not be held responsible for any loss, damage or misuse of Personal Information of the User and the Organization Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below) or any act or omission attributable to the Organization or any person claiming on the Organization’s behalf.

A “Force Majeure Event” shall mean any event that is beyond Our reasonable control and shall include, without limitation, sabotage, fire, flood, pandemic or epidemic, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption (provided beyond Our reasonable control), power or electricity failure or unavailability of adequate power or electricity.

ACCESSING AND UPDATING YOUR INFORMATION

You may change, alter or otherwise modify or update Your Information, at any time by contacting us at info@mentortechcollective.org.

Do note, MCF reserves the rights to save any Non-Personal, Device Information and usage information and You are entitled to access and seek the deletion of the same at Your discretion by emailing us at info@mentortechcollective.org.

MCF at its sole discretion may permit or deny the change of any Information, if it is believed the same is required to observe applicable laws. 

AGE RESTRICTIONS

MCF is only intended for Users who are of the age of majority in their jurisdiction of residence or Organizations competent to contract under applicable law.  You are not to provide any Personally Identifiable Information or Sensitive Personal Information or use the Portal or the Services without the consent of the authorized representative of the Organization. It is the responsibility of the Organization to ensure that any user it allows to access the Portal have appropriate consent to do so.

If it comes to MCF’s attention that any such access or Information pertains to an individual who is not competent to contract under applicable law or is under the age of majority, and that appropriate consent for said individual to use the system has not been obtained by the Organization, such Information may be deleted, the Organization may be deactivated, or the individual user barred access from the system, all without notice to You.

COMPLAINTS 

If You wish to place a complaint or raise a question/ concern with regard to Your privacy requirements, or otherwise view, modify, delete or correct any of Your Personally Identifiable Information or Sensitive Personal Information, please contact us at info@mentortechcollective.org by including “Privacy” in the subject line so that we can consider and respond to Your request/complaint. We shall endeavour to address all requests/complaints within thirty (30) days from the date of such a request/complaint being made.

AMENDMENTS TO THE PRIVACY POLICY

This Privacy Policy is subject to change at MCF’s sole discretion. Any changes to the Privacy Policy will be notified by a notice on the home page of the Portal.

CHOICE/OPT-OUT/DELETION/CORRECTION

  • If the Organization wishes to have the information or data that the Organization have provided to MCF deleted or corrected the Organization can always do so by sending a request to us at info@mentortechcollective.org by including “Privacy” in the subject line of the email. 
  • The Organization may note that correction or deletion of certain information or data may lead to cancellation of the registration with the Portal or access to certain features of the Portal the Organization and also agrees and acknowledges that certain data or information cannot be corrected or deleted or prohibited to be deleted as required under any applicable law, law enforcement requests or under any judicial proceedings.
  • Any information that is sought to be deleted, whether upon deactivation of the Organization’s account on the Portal or otherwise, shall be deleted from the user interface of the Portal but may be retained on the servers of MCF for such period as may be required under applicable laws, Terms and Condition or as per the policy of MCF or any third-party engaged by MCF.
  • The Organization acknowledges and agrees that MCF and/or any third-party engaged and authorised by MCF shall be entitled to retain such information to the extent required under this clause and MCF disclaims any liability or obligation not specifically agreed hereunder with respect to such information.
  • The Organization also agrees that any aggregated information or data based on the analysis or benchmarking activity undertaken by MCF, either manually or through related algorithms, shall be the sole property of MCF and MCF shall neither have the obligation to delete it or provide such aggregated information or data to the Organization.

EXCLUSION

This Privacy Policy does not apply to any information other than such information collected by MCF through the Portal. This Privacy Policy shall not apply to any unsolicited information that the Organization provide Us through this Portal or through any other means. This includes, but is not limited to, information posted to any public areas of the Portal. All such unsolicited information shall be deemed to be non-confidential and MCF shall be free to use, process or disclose such unsolicited information without any limitations. We make no representation that the content contained on the Portal is appropriate. MCF’s responsibility with respect to such information shall be as per the applicable laws.

SEVERABILITY

If any provision of the Privacy Policy is determined to be invalid or unenforceable, it will not affect the validity or enforceability of the other provisions of the Privacy Policy, which shall remain in full force and effect.

WAIVER

No waiver of any provision of this Privacy Policy shall be binding unless executed and notified by MCF in writing to you.  No waiver of any of the provisions of this Privacy Policy shall be deemed or shall constitute a waiver of any other provision and no waiver shall constitute a continuing waiver. You hereby waive any present or future claims you have against MCF arising from Your/Your Representatives’ use of the Portal or any other User’s and/or Organization’s conduct.

LANGUAGE

This document may be translated into different language/s. In the event of any conflict between the translated version and this version of the Privacy Policy, the clauses of this version of the Privacy Policy in English shall prevail.

We may disclose Your Information to our agents, employees, advisors and affiliates who require the Information for the purposes of operating and maintaining the Portal and for facilitating Your use of the Services offered on the Portal. Whenever we hire other organizations to provide support services, they will be required to conform to our privacy standards. These third parties shall use the Information only for purposes related to the supply of services to us and they will also respect strict contractual conditions that oblige them to maintain the confidentiality of all Information.

Organizations that run their programmes on the Portal may have data sharing arrangements with third parties authorizing MCF to share Your Information with such third parties. Your consent shall be obtained accordingly by the respective Organization running a virtual mentoring programme on the Portal, before any such Information is shared. You are at liberty to grant or refuse to consent to providing any Information as may be requested, at Your discretion.

We may anonymize Your Information and create aggregated data that may be published at our discretion. However, Your Information, as provided to us, shall not be disclosed or published without Your express consent, in accordance with this Policy.

MCF may be involved in the transaction of a merger, acquisition, sale of assets, business re-organization, bankruptcy, transfer of business or operation etc. During such a process, it may sell, transfer or otherwise share some or all of its assets which may include the information of the User. However, in such an event of sale or transfer, MCF shall reasonably ensure that the User’s information collected and stored by MCF is stored and used by the transferee in a manner that is consistent with this Privacy Policy. Any such third party to whom We transfer or sell shall have the right to continue to use the information that the User provide to Us or collected by Us immediately prior to such transfer or sale. On completion of the sale or transfer, the Privacy Policy of the third party shall apply with respect to the information of the User. To stay updated about such business transactions, please read this Policy from time to time.

We assume no liability for any disclosure of information due to errors in transmission, unauthorised third-party access or other acts of third parties, or acts or omissions beyond Our reasonable control and the User agrees that the User will not hold Us responsible for any breach of security unless such breach has been caused as a direct result of Our gross negligence or wilful default.

DATA RETENTION

MCF may retain Information, for such length of time as may be required in order for MCF to provide the concerned User with Services or to fulfil the purpose for which such Information was collected, comply with legal obligations, resolve any disputes that may arise, enforce its rights arising out of agreements with Users, and/or for such period as may be required or mandated by legislations/orders of regulatory authorities to which MCF is subject. For information collected by Organizations in the course of providing virtual mentoring programmes on the Portal, Users shall be entitled to write to the Organizations directly requesting removal or deletion of such information collected, at the discretion of the User.

PRIVACY RIGHTS

You acknowledge that the Portal is operated and managed on servers that may be located and operated in or outside the territory or country wherein You reside or operate. By using and accessing the Portal, You consent to the transfer to and processing of Your Information including the Sensitive Personal Information and the Personally Identifiable Information, on servers that may be located in or outside the jurisdiction wherein You reside, in accordance with applicable laws. Data may be transmitted to countries outside the country wherein You reside or operate for the purpose of technical support and analysis as per this Privacy Policy and shall not be stored permanently in this regard. As a result, the applicable country’s courts, governments, or law enforcement agencies could obtain disclosure of Your Information in accordance with that country’s laws. If You chose to avail the Services or use of the Portal anywhere, You shall choose to do so at Your own risk and You acknowledge that You shall be solely responsible for any compliance with applicable laws in the jurisdiction from which You use the Services or the Portal.

DATA SECURITY

The Information that You provide, subject to disclosure in accordance with this Privacy Policy and Terms of Use, shall be maintained in a safe and secure manner and shall be encrypted at rest and in transit. MCF’s databases and Information are stored on secure servers with appropriate firewalls owned by MCF or by third parties.

You have the responsibility to ensure data security including that of Your User Information. You should use the Portal in a responsible manner, and You will not take any action that will cause a breach of the use of the Portal. You are solely responsible for all acts done using User Information that has been provided to You in the course of the Services.

Given the nature of internet transactions, MCF does not take any responsibility for the transmission of Information including the User Information or Organization Content that You provide to the Portal. Any transmission of Your Information on the internet is done at Your risk. MCF does not take any responsibility for You or any third party circumventing the privacy settings or security measures contained on the Portal.

While MCF will use all reasonable efforts to ensure that Your Information is safe and secure, it offers no representation, warranties or other assurances that the security measures are adequate, safe, fool proof or impenetrable. 

FORCE MAJEURE

Notwithstanding anything contained in this Privacy Policy or elsewhere, MCF shall not be held responsible for any loss, damage or misuse of Personal Information of the User, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below) or any act or omission attributable to the User or any person claiming on the User’s behalf.

A “Force Majeure Event” shall mean any event that is beyond Our reasonable control and shall include, without limitation, sabotage, fire, flood, pandemic or epidemic, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption (provided beyond Our reasonable control), power or electricity failure or unavailability of adequate power or electricity.

ACCESSING AND UPDATING YOUR INFORMATION

You may change, alter or otherwise modify or update Your Information, at any time by contacting us at info@mentortechcollective.org and including “Privacy” in the subject line of the email.

Do note, MCF reserves the rights to save any Non-Personal, Device Information and usage information and You are entitled to access and seek the deletion of the same at Your discretion by emailing us at info@mentortechcollective.org.

MCF at its sole discretion may permit or deny the change of any Information, if it is believed the same is required to observe applicable laws. 

AGE RESTRICTIONS

The MCF is only intended for Users who are of the age of majority in their jurisdiction of residence or competent to contract under applicable law. If You are not of the age of majority, You are not to provide any Personally Identifiable Information or Sensitive Personal Information or use the Portal or the Services without the consent of a parent or legal guardian.

If it comes to MCF’s attention that any such access or Information pertains to an individual who is not competent to contract under applicable law or is under the age of majority, and that appropriate consent for said individual to use the system has not been obtained by the Organization, such Information may be deleted, the Organization may be deactivated, or the User barred access from the system, all without notice.

COMPLAINTS 

If You wish to place a complaint or raise a question/ concern with regard to Your privacy requirements, or otherwise view, modify, delete or correct any of Your Personally Identifiable Information or Sensitive Personal Information, please contact us at info@mentortechcollective.org so that we can consider and respond to Your request/complaint and include “Privacy” in the subject line of the email. We shall endeavour to address all requests/complaints within thirty (30) days from the date of such a request/complaint being made.

AMENDMENTS TO THE PRIVACY POLICY

This Privacy Policy is subject to change at MCF’s sole discretion. Any changes to the Privacy Policy will be notified by a notice on the home page of the Portal.

CHOICE/OPT-OUT/DELETION/CORRECTION

  • If the User wish to have the information or data that the User have provided to MCF deleted or corrected, the User can always do so by sending a request to us by e-mail info@mentortechcollective.org and include “Privacy” in the subject line of your email.
  • The User may note that correction or deletion of certain information or data may lead to cancellation of the registration with the Portal or access to certain features of the Portal the User and also agrees and acknowledges that certain data or information cannot be corrected or deleted or prohibited to be deleted as required under any applicable law, law enforcement requests or under any judicial proceedings.
  • Any information that is sought to be deleted, whether upon deactivation of the User’s account on the Portal or otherwise, shall be deleted from the user interface of the Portal but may be retained on the servers of MCF for such period as may be required under applicable laws, Terms and Condition or as per the policy of MCF or any third-party engaged by MCF.
  • The User acknowledges and agrees that MCF and/or any third-party engaged and authorised by MCF shall be entitled to retain such information to the extent required under this clause and MCF disclaims any liability or obligation not specifically agreed hereunder with respect to such information.
  •  The User also agrees that any aggregated information or data based on the analysis or benchmarking activity undertaken by MCF, either manually or through related algorithms, shall be the sole property of MCF and MCF shall neither have the obligation to delete it or provide such aggregated information or data to the User.

EXCLUSION

This Privacy Policy does not apply to any information other than such information collected by MCF through the Portal. This Privacy Policy shall not apply to any unsolicited information the User provide us through this Portal or through any other means. This includes, but is not limited to, information posted to any public areas of the Portal. All such unsolicited information shall be deemed to be non-confidential and MCF shall be free to use, process or disclose such unsolicited information without any limitations. We make no representation that the content contained on the Portal is appropriate. MCF’s responsibility with respect to such information shall be as per the applicable laws. If the User intend to use or access the Portal from outside territory as may be defined by MCF from time to time, the User may do so at the User’s own risk and is responsible for compliance with the laws of such jurisdiction.

SEVERABILITY

We have taken every effort to ensure that this Privacy Policy adheres with the applicable laws. The invalidity or unenforceability of any part of this Policy shall not prejudice or affect the validity or enforceability of the remainder of this Privacy Policy. This Privacy Policy does not apply to any information other than the information collected by MCF through the Portal.

WAIVER

Any rights or remedies under this Privacy Policies may be waived only in writing. Delay in exercising or non-exercise of any such right or remedy does not constitute a waiver of that right or remedy, or any other right or remedy.

LANGUAGE

This document may be translated into different language/s. In the event of any conflict between the translated version and this version of the Privacy Policy, the clauses of this version of the Privacy Policy in English shall prevail.
